By accessing or using CostFlowAI ("Service", "Website", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

CostFlowAI provides free construction cost estimation calculators for concrete, drywall, roofing, and other construction materials. Our calculators use industry-standard formulas to help contractors and homeowners estimate project costs.

CostFlowAI offers both free and paid tiers. Free tier includes all 21 construction cost calculators with full functionality. Pro tier ($29/month or $249/year) includes additional features such as branded PDF exports, XLSX exports, saved project history, shareable estimate links, and unlimited AI Budget Assistant access.

3. Use of Service

3.1 Permitted Use

You may use our Service for:

• Estimating construction material quantities and costs
• Personal or commercial project planning
• Educational purposes

3.2 Prohibited Use

You may NOT:

• Use the Service for any illegal purpose
• Attempt to hack, reverse engineer, or compromise the Service
• Use automated tools to scrape or extract data excessively
• Misrepresent your identity or affiliation
• Interfere with other users' access to the Service

4. Accuracy and Disclaimer

IMPORTANT: Our calculators provide estimates only.

• Results are based on industry-standard formulas and assumptions
• Actual project costs may vary based on location, materials, labor rates, and site conditions
• We do not guarantee the accuracy of calculations
• Always verify estimates with professional contractors and suppliers

USE AT YOUR OWN RISK. CostFlowAI is not responsible for any financial losses, project delays, or other damages resulting from use of our calculators.

5. Intellectual Property

All content on CostFlowAI, including calculator logic, design, text, and graphics, is owned by CostFlowAI and protected by copyright and intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works without our express written permission.

6. User Content

When you use our calculators, you may input project dimensions and specifications. You retain ownership of your input data. However, we may collect anonymized usage data to improve our Service.

7. Subscription Terms

7.1 Billing

Pro subscriptions are billed monthly or annually through Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method at the applicable rate until you cancel.

7.2 Free Trial

New Pro subscribers may receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

7.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting costflowai@gmail.com. Cancellation takes effect at the end of your current billing period. You will retain Pro access until that date.

7.4 Refunds

We offer a 14-day money-back guarantee on all new subscriptions. If you are not satisfied within the first 14 days of your paid subscription, contact us for a full refund. After 14 days, no refunds are issued for partial billing periods.

7.5 Price Changes

We may change subscription prices with 30 days notice. Existing subscribers will be notified by email before any price increase takes effect.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CostFlowAI provides the Service "AS IS" without warranties of any kind
• We are not liable for any direct, indirect, incidental, or consequential damages
• This includes damages from incorrect calculations, data loss, or business interruption
• Our total liability shall not exceed the greater of $100 USD or the total amount paid by you to CostFlowAI in the twelve (12) months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless CostFlowAI from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

11. Third-Party Services

Our website may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

12. Modifications to Service

We reserve the right to:

• Modify or discontinue the Service at any time
• Change these Terms of Service
• Update calculator formulas and pricing data

Significant changes will be posted on this page with an updated "Last Updated" date.

13. Termination

We may terminate or suspend your access to the Service immediately, without notice, for any reason, including violation of these Terms.

14. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
